Scratch Monkeys | Affiliate Terms and Conditions

As an approved Affiliate of ScratchMonkeys.com you agree to abide by the terms and conditions contained in this Agreement. Please read the entire Agreement carefully before registering and promoting ScratchMonkeys.com as an Affiliate.

Your participation in this Program is solely to legally advertise our website to receive a commission on digital products purchased by individuals referred to ScratchMonkeys.com by your own website, platform, or personal referrals.

By signing up you indicate your acceptance of this Agreement and its terms and conditions.

APPROVAL OR REJECTION OF THE APPLICATION

We reserve the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

COMMISSIONS

Commissions will be paid bi-weekly using PayPal. PayPal payout fees may apply depending on the type of PayPal account you have and ScratchMonkeys are not responsible to cover these fees. Affiliates will earn 5% of the total purchase value your referral makes on their first order whilst on our website. You cannot refer yourself, and you will not receive a commission on your own accounts. Payments will only be sent for transactions that have been successfully completed. Transactions that result in chargebacks or refunds will not be eligible for commission. If a transaction results in a chargeback or a refund after a commission is paid, then the adjustment will be made to the proceeding payout.

TERMINATION

Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

The use of fake promotions, or any other method of manipulation to gain clicks.
Coupon sites are not allowed to participate in our Program
Inappropriate advertisements (false claims, misleading hyperlinks, offensive images/text, etc.).
Advertising on sites containing or promoting illegal/sexual activities.
Self-referrals, fraudulent transactions, or suspected Affiliate fraud.

In addition to the above ScratchMonkeys.com reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement.

LIABILITY

ScratchMonkeys.com will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, or loss of database files on our website. We make no claim that the operation of the Program and/or our website will be error-free and we will not be liable for any interruptions or errors.

TERMS OF AGREEMENT

The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated. We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate Program rules.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed in accordance by the laws in the state of California, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute that might arise between you and ScratchMonkeys.

DISPUTES

Any dispute relating in any way to your participation in the Affiliate Program shall be adjudicated in a state or federal court in Los Angeles County, California, and you consent to such exclusive jurisdiction and venue in such courts.
